How much does a divorce cost in Florida?

Are you concerned about getting a divorce because of how much it may cost? It is no secret that divorce can be very detrimental to your financial security both now and in the future. Add on the fact that Florida ranks high in divorce costs, and you may be searching for DIY forms or cheap lawyers.

The good news is that you have more control over the cost of your divorce than you think. How much you may spend will depend on the following factors.

How you divorce

The way you divorce is probably the most influential factor in the final cost. If you have few assets, no children or both, you may qualify for a flat-fee uncontested divorce. Even if you have many assets and children, you may still be able to get an uncontested divorce if you both can agree on all terms.

This situation is not very common, but it is not the only cost-effective option you have. You can also try mediation or negotiation. Mediation entails meeting with a neutral third party who facilitates communication and cooperation so you and your spouse can decide on your divorce terms. Your attorneys review the final document before submission.

Negotiation involves both of you and your lawyers (no mediator) working together to come to an agreement. It is better than mediation if you want to use lawyers but do not want to battle in the courtroom. If traditional litigation is necessary, it does not have to be hostile. No matter which you choose, having legal representation is always best in avoiding mistakes, delays and additional fees.

What your family circumstances are

Individual circumstances make the final price unique to your situation. You cannot compare the cost of your divorce to a friend’s even if you both take the same approach. Aspects that affect expenses are:

  • The number of assets you have and their complexity
  • How many children you have and how old they are
  • The length of your marriage
  • The presence of abuse or domestic violence
  • Whether you and/or your spouse is in the military

Although some factors are uncontrollable, others you can dictate to reduce the cost of your Florida divorce.
